2. What Happens After You Submit a DMCA Notice
We review your notice within 1-2 business days
If valid, we remove the infringing content immediately
The user who uploaded the content receives a copyright strike
We notify the user of the takedown and provide them with your contact information (as required by law)
The user has the right to file a counter-notification (see Section 4 below)

Required Information:
Identification of removed content: Describe the content removed and its location before removal (URL)
Good faith statement: "Under penalty of perjury, I have a good faith belief that the content was removed as a result of mistake or misidentification."

Counter-Notification Timeline:
We receive your valid counter-notification
We forward it to the original claimant who filed the DMCA notice
The original claimant has 10-14 business days to file a court action against you
If they do not file a court action within that period, we may restore your content
WARNING: Knowingly misrepresenting that material was removed by mistake makes you liable for damages (including costs and attorneys' fees). Only file a counter-notification if you genuinely believe your content is not infringing or qualifies as fair use.
5. Fair Use Protection
Upskrol respects the doctrine of fair use. Content that qualifies as fair use under Section 107 of the U.S. Copyright Act (or equivalent fair dealing laws) should not be removed. Examples of fair use include:
Criticism and commentary: Using short clips to analyze, critique, or review the original work
Political commentary: Using clips of public figures or government proceedings for criticism or satire
News reporting: Using clips to report on current events
Educational use: Using clips for teaching or analysis
Parody and satire: Using clips to ridicule or mock public figures or works
If your content qualifies as fair use, you should submit a counter-notification explaining why.
6. Repeat Infringer Account Termination
Upskrol terminates accounts of repeat infringers. A "repeat infringer" is defined as any user who:
Receives 3 or more copyright strikes, OR
Has 2 or more counter-notifications rejected as invalid, OR
Has been found by a court to have infringed copyright on Upskrol
Terminated accounts lose all content and cannot create new accounts.
7. Appeals
If your account has been warned, suspended, or banned due to copyright strikes, you may appeal by emailing legal@upskrol.com with:
Your username and email address
The action you are appealing (warning, suspension, or ban)
Why you believe the strikes were issued in error
Any supporting evidence (licenses, permissions, fair use justification)
